TERMS & CONDITIONS (INFLUENCERS)

Sock Season would like to promote and share your content in conjunction with the promotion of our brand and products.

By posting, distributing, sending or displaying any comment, message (including email), data, information, text, music, sound, photos, graphics, or other content (the “User Generated Content”), posted with the hashtag #SockSeason or #SockSeasonBrand, or tagged with the @sockseason accounts, you grant Sock Season a royalty-free, perpetual, irrevocable, worldwide license to edit and use your content for all marketing and advertising purposes, including but not limited to: Instagram, Facebook, Twitter, Snapchat, Pinterest, Tumblr, LinkedIn, YouTube, Vimeo, Line, Weibo, WeChat, TikTok and on www.sockseason.com and in other online or offline media, including without limitation, on the website gallery, in newsletters, catalogs, email and other customer communications, store materials and other marketing purposes.

You further grant Sock Season the right to pursue at law any person or entity that violates your or Sock Season’s rights in the User Generated Content by a breach of these Conditions. User Generated Content submitted by users is deemed non-confidential and Sock Season is under no obligation to treat such User Generated Content as proprietary information. Without limiting the foregoing, Sock Season reserves the right to use the User Generated Content as it deems appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. Sock Season is under no obligation to offer you any payment for User Generated Content or to attribute authorship of User Generated Content to you.

This license can also be transferred by SS and its affiliated companies to third party collaborators for the purpose of promoting products under the Sock Season brand. This license also includes a right, but not an obligation, to refer to the creator of the User Generated Content and the social media account where the User Generated Content was uploaded.
You confirm that you own or control the rights to the User Generated Content. If you are under 18 years old you guarantee that you have your parents consent. You hereby release and discharge Sock Season from all and any obligation to pay you for any use of your User Generated Content and any of the intellectual property rights contained therein in connection with the uses described above; and You hereby release, discharge and agree to hold Sock Season and any person acting on Sock Season’s behalf harmless from all claims, demands, and liabilities whatsoever in connection with use of the User Generated Content as described above. Furthermore, you certify that the User Generated Content submitted by you does not violate any rights of a third party or any law.

By working with the Social Commerce team on a collaborative/campaign basis, you willingly submit your information, such email address, social media account name and shipping address to Sock Season. We process the collected information only for the purpose of administering and maintaining the collaboration relationship.

You have the right to request access to the personal data that we store about you. You also have the right to request that incorrect or incomplete personal data is corrected. Furthermore, you have the right, to the extent our processing is based on your consent, to at any time revoke your consent to our processing of your personal data. Should you have any issues regarding our processing of your personal data, please do not hesitate to contact us. Naturally, you also have the right to lodge a complaint with your local Data Inspection Board should you wish.

As of 25 May 2018, you also have, to the extent applicable data protection laws provide, a right to erasure of personal data, restriction of processing, to object to certain processing and a right to data portability.

The right to data portability covers such personal data that you have provided to us and which we process either based on your consent or in order to fulfill our contractual obligations in relation to you. This typically includes your name, e-mail address and address.
